Genetic testing has familial implications. Counsellors find themselves in (moral) conflict between medical confidentiality (towards the patient) and a potential right or even duty to warn at-risk relatives. Legal regulations vary between countries. English literature about German law is scarce. We reviewed the literature of relevant legal cases, focussing on German law, according to the Preferred Reporting Items for Systematic Reviews and Meta-Analyses guidelines. This article aims to familiarise counsellors with their responsibilities, compare the situation between countries and point out (...) legally unresolved areas.According to the German Genetic Diagnostics Act (Gendiagnostikgesetz) in case of an ‘avoidable or treatable’ genetic disorder, geneticists ought to confine themselves to the obligated advice to the patient. Whether a breach of the duty of confidentiality can be justified in exceptional cases by ‘necessity as justification’ for actively informing relatives at risk remains legally unclear. In case of a ‘neither avoidable nor treatable’ genetic disease, geneticists should also refrain from actively informing relatives as the justifiable state of emergency does not permit to break the duty of confidentiality. Despite its intuitive appeal and the empirical evidence for it, the hypothesis of cognitive polyphasia (Moscovici, 1961/1976/2008) remains largely unexplored. This article attempts to clarify some of the ideas behind this concept by examining its operations at the level of individuals and by proposing a conceptual model that includes some elements of social cognition. Indeed, calls for a rapprochement between the theory of social representations and cognitive psychology have been made by Moscovici, in particular, in his 1984 paper on The (...) myth of the lonely paradigm and in his paper on La nouvelle pensée magique (1992) in which he argues that the theory of social representations provides an explanatory framework for the descriptions offered by cognitive psychology and that their combining could translate into a finer understanding of contemporary social phenomena.Building on the results of an empirical examination of the controversy that surrounded the MMR vaccination programme in the UK between 1998 and 2005, different ways of engaging into cognitive polyphasia are proposed, including what can be described as cognitive “monophasia”, that is, the exclusive use of one type of knowledge, at least at the level of the individual. A brief discussion about the implications of the proposed conceptual model for our understanding of cognitive polyphasia and of the different ways of making sense of the world around us concludes this article. Performance Generating Systems (PGS) are rule- and task-based approaches to improvisation on stage in theatre, dance, and music. These systems require performers to draw on predefined source materials (texts, scores, memories) while working on complex tasks within limiting rules. An interdisciplinary research team at a large Western Canadian university hypothesized that learning to sustain this praxis over the duration of a performance places high demands on executive functions; demands that may improve the performers’ executive abilities. These performers need to continuously (...) shift attention while remaining responsive to embodied and environmental stimuli in the present, they are required to inhibit automated responses and impulses using the rules of the system, and they strive towards addressing multitasking challenges with fluidity and flexibility. This study set out to test the mentioned hypothesis deductively and identify mediating processes inductively, using mixed empirical methods. In a small sample experiment with a control group (28 participants; 15 in intervention group, 13 in control group), standardized quantitative tests of executive functions (D-KEFS) were administered before and after an eight-week intervention. Participant-reported qualitative observations from the praxis were also collected throughout the intervention for grounded analysis. Within the limitations of small sample data, we found both statistically significant and trending effects on inhibition, problem-solving initiation, fluidity, and cognitive flexibility. Examining the mediating process, we found that participants experienced significant challenges sustaining the practice halfway through the intervention. The participant-reported solutions to these challenges, which emerged as the strongest behavioural patterns when coding the qualitative data to saturation, were strategies of problem-solving and of re-directing attention. These strategies support and advance our understanding of the effects measured in the standardized tests. In terms of application, our results identify characteristics of PGS that could potentially maintain and strengthen executive functions over and above less demanding performing arts interventions. The results also deliver new insight into how PGS works, which may contribute to the development and teaching of this artistic practice. (shrink)

Sentencing in homicide depends on how psychiatrists view the issues of Section 2. In most killings that do not involve clear-cut mental disorder, strong emotions and stress play a part. Both can be cited in aid of diminished responsibility. If doctors cite them, however tentatively, it becomes feasible for the court to review any mitigating factors and to choose an appropriate penalty. Otherwise, the mandatory penalty is imposed. Thus doctors, by opining not on the medical but on the legal and (...) moral aspects of Section 2, decide who shall automatically get a life sentence and who shall not. Anomaly and injustice are the results. They would be remedied by the abolition of the mandatory sentence for murder. (shrink)

The ability of dance to address social isolation is argued, but there is a lack of both evidence of such an effect and interventions designed for the purpose. An interdisciplinary research team at University of Calgary partnered with Kaeja d’Dance to pilot test the effects of an intervention designed to facilitate embodied social connections among older adults. Within a mixed methods study design, pre and post behavioral tests and qualitative surveys about experiences of the body and connecting were administered to (...) thirteen participants along with test instruments of loneliness and body appreciation. In the short-term, no significant changes were found on quantitative tests. Exploratory analysis revealed intervention improvements on individual body appreciation questions only. This indication of change was strongly supported by converging qualitative data and identified as relating to: increased connection through task-based collaboration, increased awareness of interpersonal boundaries, and a shift to experiencing the body as responsive. These indications of increased relational capacity were deemed likely to cause further impact in the long term. Examining this possibility and the subsequently arisen factor of COVID-19 risks and restrictions, test instruments were administered again to 10 participants 4 and 5 months after the intervention. A significant increase in loneliness was found. Despite this negative impact of COVID-19 isolation, several positive intervention changes remained detectable and some continued to increase over time. Seventy percent of the participants, who made new social contacts during the intervention and later sought continued contact, improved significantly across all body appreciation measures over the full study. The qualitative data from the last two time-points revealed both consistent values and new, negative changes. While these preliminary findings speak to the durability of intervention changes, they also identify areas of urgent priority to help older adults restore embodied relational capacity that has declined during COVID-19. Within the limitations of a small-sample pilot study, converging mixed methods results support the hypothesis that dance interventions designed for the purpose can positively affect the social inclusion of older adults. Although we recommend further study, these promising results also indicate that dance interventions can help older adults recover from pandemic isolation. (shrink)

The authors' claim that analogical reasoning is the product of relational priming is compatible with language processing work that emphasizes the role of low-level automatic processes in the alignment of situation models in dialogue. However, their model ignores recent behavioral evidence demonstrating a effect on relational priming. We discuss implications of these data.

My target is the epistemological dimension of the realism debate. After establishing a stance voluntarist framework with a Jamesian background, drawing mostly on Wylie, Chakravarty, and van Fraassen, I argue that current voluntarists are too permissive. I show that especially various anti-realist stances but also some realist and selective realist stances block themselves from refutation by the history of science. I argue that such stances should be rejected. Finally, I propose that any disagreement that cannot be resolved by this strategy (...) frequently boils down to an epistemic value disagreement about balancing the truth-goal. (shrink)

This paper discusses how Kierkegaard’s aesthete in Either/or’s “Diapsalmata” and “Rotation of Crops” attempts to apply Hegel’s principle of mediation to everyday decision-making. This paper has two main goals: First, it provides an in-depth analysis of exactly how the aesthete’s approach to decision-making follows the dialectical pattern of Hegelian mediation. Second, it argues that even though the aesthete meets with unfortunate results, the aesthete cannot be so easily dismissed. This article analyzes the “Interlude” in Kierkegaard’s Philosophical Fragments. In particular, it examines Johannes Climacus’s response to Hegel’s view that a past actuality is necessary. I provide an in-depth analysis of Hegel’s view of modality and of what he means when he says that a past actuality is necessary. In contrast to the standard scholarly interpretation, I argue that Climacus need not reject Hegel’s view because Hegel’s view of the necessity of the past is not so controversial or difficult to (...) accept. Finally, I show that Climacus’s main critique is that we cannot know the past as necessary in any meaningful way. He worries that we might get so preoccupied with the futile task of trying to know the Hegelian necessity of the past that we forget to personally appropriate the past in a way that can help us live in the present. This paper sets out from the hypothesis that the embodied competences and expertise which characterise dance and sports activities have the potential to constructively challenge and inform phenomenological thinking. While pathological cases present experiences connected to tangible bodily deviations, the specialised movement practices of dancers and athletes present experiences which put our everyday experiences of being a moving body into perspective in a slightly different sense. These specialised experiences present factual variations of how moving, sensing and interacting can be like (...) for us as body-subjects. To use of these sources inevitably demands that qualitative research methodologies – especially short-term ethnographical fieldwork – form part of the research strategy and qualify the way the researcher involves a second-person perspective when interviewing dancers and athletes about their experiences. In the subsequent phases analysing the data generated, I argue that researchers first strive to achieve internal consistency of empirical themes identified in the case of movement practices in question thus keeping to a contextualised and lived perspective, also denoted as an emic perspective. In subsequent phases phenomenological insights are then actively engaged in the exploration and discussion of the possible transcendental structures making the described subjective experiences possible. The specialised and context-defined experiences of ‘what a moving body can be like’ are accordingly involved as factual variations to constructively add to and potentially challenge phenomenological descriptions. Lastly, I exemplify how actual research strategies have been enacted in a variety of projects involving professional dancers’, golfers’ and sports dancers’ practices and experiences, respectively. There is now a significant body of literature on consequentialist ethics that propose satisficing instead of maximizing accounts. Even though epistemology recently witnessed a widespread discussion of teleological and consequentialist theories, a satisficing account is surprisingly not developed yet. The aim of this paper is to do just that. The rough idea is that epistemic rules are justified if and only if they satisfice the epistemic good, i.e., reach some threshold of epistemic value (which varies with practical context), and believing (...) is justified if and only if it follows said rules.I argue that this alternative to the implicitly established way of thinking in maximizing terms has significant advantages. First, maximizing epistemic value can be unreasonably demanding; second, a satisficing theory can make finding reasonable rules for belief formation and sustenance much more accessible; and third, a satisficing approach is a better alternative to both general subjectivist and maximizing objectivist attempts to spell out epistemic blame. Author Susanne Claxton offers a new ecophenomenological perspective to Heidegger and his engagement with the Greeks, and an alternative to the ruling binary in environmental ethics of anthropocentrism and ecocentrism.

In this article, we inquire into Maxine Sheets-Johnstone and Michele Merritt’s descriptions and use of dance improvisation as it relates to “thinking in movement.” We agree with them scholars that improvisational practices present interesting cases for investigating how movement, thinking, and agency intertwine. However, we also find that their descriptions of improvisation overemphasize the dimension of spontaneity as an intuitive “letting happen” of movements. To recalibrate their descriptions of improvisational practices, we couple Ezequiel Di Paolo, Thomas Buhrmann, and Xabier E. (...) Barandiaran’s enactive account of the constitution of agency with case studies of two expert performers of improvisation: a dancer and a musician. Our analyses hereof show that their improvisations unfold as a sophisticated oscillation of agency between specialized forms of mental and bodily control and, indeed, a more spontaneous “letting things happen.” In all, this article’s conclusions frame thinking in movement concerning improvisational practices as contextually embedded, purposively trained, and inherently relational. ABSTRACT: Alexander of Aphrodisias’ commentaries on Aristotle’s Organon are valuable sources for both Stoic and early Peripatetic logic, and have often been used as such – in particular for early Peripatetic hypothetical syllogistic and Stoic propositional logic. By contrast, this paper explores the role Alexander himself played in the development and transmission of those theories. There are three areas in particular where he seems to have made a difference: First, he drew a connection between certain passages from Aristotle’s Topics and (...) Prior Analytics and the Stoic indemonstrable arguments, and, based on this connection, appropriated at least four kinds of Stoic indemonstrables as Aristotelian. Second, he developed and made use of a specifically Peripatetic terminology in which to describe and discuss those arguments – which facilitated the integration of the indemonstrables into Peripatetic logic. Third, he made some progress towards a solution to the problem of what place and interpretation the Stoic third indemonstrables should be given in a Peripatetic and Platonist setting. Overall, the picture emerges that Alexander persistently (if not always consistently) presented passages from Aristotle’s logical œuvre in a light that makes it appear as if Aristotle was in the possession of a Peripatetic correlate to the Stoic theory of indemonstrables. On March 11, 2020 the World Health Organization classified COVID‐19, caused by Sars‐CoV‐2, as a pandemic. Although not much was known about the new virus, the first outbreaks in China and Italy showed that potentially a large number of people worldwide could fall critically ill in a short period of time. A shortage of ventilators and intensive care resources was expected in many countries, leading to concerns about restrictions of medical care and preventable deaths. In order to be prepared for (...) this challenging situation, national triage guidance has been developed or adapted from former influenza pandemic guidelines in an increasing number of countries over the past few months. In this article, we provide a comparative analysis of triage recommendations from selected national and international professional societies, including Australia/New Zealand, Belgium, Canada, Germany, Great Britain, Italy, Pakistan, South Africa, Switzerland, the United States, and the International Society of Critical Care Medicine. We describe areas of consensus, including the importance of prognosis, patient will, transparency of the decision‐making process, and psychosocial support for staff, as well as the role of justice and benefit maximization as core principles. We then probe areas of disagreement, such as the role of survival versus outcome, long‐term versus short‐term prognosis, the use of age and comorbidities as triage criteria, priority groups and potential tiebreakers such as ‘lottery’ or ‘first come, first served’. Having explored a number of tensions in current guidance, we conclude with a suggestion for framework conditions that are clear, consistent and implementable. This analysis is intended to advance the ongoing debate regarding the fair allocation of limited resources and may be relevant for future policy‐making. (shrink)

Joining a vast Wittgensteinian anti-theoretical movement, John Canfield has argued that it is possible to read the claims that (1) “language is essentially communal” and (2) “it is conceptually possible that a Crusoe isolated from birth should speak or follow rules” in such a way that they are perfectly compatible, and, indeed, that Wittgenstein held them both at once. The key to doing this is to drain them of any theoretical content or implications that would put each claim at odds (...) with the other. I argue here, first of all, that it is not possible to detheorize both (1) and (2) and still hope to say anything illuminating about the nature of language. In fact, Canfield himself does not succeed in detheorizing both (1) and (2) but ends up trivializing (1) and leaving (2) with quite a bit of theoretical content. I further argue, however, that this is getting the matter the wrong way around. Contra Canfield et al., it is only when we recognize this that we can appreciate how radical and innovative Wittgenstein's claims about language really are. (shrink)

This book offers a new account of what it is to act for a normative reason. The first part of the book examines the problems of causal accounts of acting for reasons and suggests to solve them by a dispositional approach. The author argues for a dispositional account which unites epistemic, volitional, and executional dispositions in a complex normative competence. This ‘Normative Competence Account’ allows for more and less reflective ways of acting for normative reasons. The second part of the (...) book clarifies the relation between the normative reason that an agent acts for and his or her motivating reasons. It refutes the widely held ‘identity view’ that acting for a normative reason requires the normative reason to be identical with a motivating reason. The author describes how normative reasons are related to motivating reasons by a relation of correspondence, and proposes a new understanding of how normative reasons explain those actions that are performed for them. Determined by Reasons engages with current debates from a wide range of different philosophical areas, including action theory, metaethics, moral psychology, epistemology, and ontology, to develop a new account of acting for normative reasons. Respectfulness is demanded of doctors and predicts more positive patient health-related outcomes, but research is scarce on ways to promote it. This study explores two ways to conceptualize unconditional respect from medical students, defined as respect paid to people on the basis of their humanity, in order to inform strategies to increase it. Unconditional respect conceptualized as an attitude suggests that unconditional respect and conditional respect are additive, whereas unconditional respect conceptualized as a personality trait suggests that people who are (...) high on unconditional respect afford equal respect to all humans regardless of their merits. One hundred and eighty-one medical students completed an unconditional respect measure then read a description of a respect-worthy or a non-respect-worthy man and indicated their respect towards him. The study found a main effect for unconditional respect and a main effect for target respect-worthiness but no interaction between the two when respect paid to the target was assessed, supporting the attitude-based conceptualization. This suggests that unconditional respect can be increased through relevant interventions aimed at increasing the relative salience to doctors of the human worth of individuals. Although artificial intelligence has been given an unprecedented amount of attention in both the public and academic domains in the last few years, its convergence with other transformative technologies like cloud computing, robotics, and augmented/virtual reality is predicted to exacerbate its impacts on society. The adoption and integration of these technologies within industry and manufacturing spaces is a fundamental part of what is called Industry 4.0, or the Fourth Industrial Revolution. The impacts of this paradigm shift on the human operators (...) who continue to work alongside and symbiotically with these technologies in the industry bring with it novel ethical issues. Therefore, how to design these technologies for human values becomes the critical area of intervention. This paper takes up the case study of robotic AI-based assistance systems to explore the potential value implications that emerge due to current design practices and use. We argue that the societal consequences of the scientific realism debate, in the context of science-to-public communication are often overlooked and careful theorizing about it needs further empirical groundwork. As such, we conducted a survey experiment with 130 academics (from physics, chemistry, and biology) and 137 science communicators. We provided them with an 11-item questionnaire probing their views of scientific realism and related concepts. Contra theoretical expectations, we find that (a) science communicators are generally more inclined towards scientific antirealism when (...) compared to scientists in the same academic fields, though both groups show an inclination towards realism and (b) academics who engage in more theoretical work are not less (or more) realist than experimentalists. Lastly, (c), we fail to find differences with respect to selective realism but find that science communicators are significantly less epistemically voluntarist compared to their academic counterparts. Overall, our results provide first empirical evidence on the views of scientists and science communicators on scientific realism, with some results running contra to the theoretical expectations, opening up new empirical and theoretical research directions. Cette etude est une lecture, une interpretation feministe de trois romans des Lumieres - Les Illustres Francaises de Challe (la sixieme histoire) (1713), L'Histoire du chevalier des Grieux et de Manon Lescaut de Prevost (1731), et Le Diable amoureux de Cazotte (1772) - notamment du theme de la vertu feminine et de ses transgressions, sur le plan sexuel, a une epoque de transformation profonde dans le domaine de l'ethique et des moeurs. Pris au piege entre la tradition et les nouvelles (...) valeurs de la Philosophie, les trois auteurs - dans des recits narres a la premiere personne par des protagonistes masculins - presentent la femme obliquement. Leur approche frappe la lectrice par son essentielle ambiguite. Tout d'abord consideree comme coupable - accusee d'adultere et de perfidie, ou de seduction diabolique - la femme apparait progressivement innocente, et meme sainte, sur l'archetype de Marie-Madeleine, ou tout simplement chimerique, produit de l'imaginaire masculin. Son existence marginale, evoquee par le biais du souvenir, est symptomatique d'une absence effective en tant que sujet autonome.Simple objet, spectrale, a la fois exclue, en fin de compte, du bien et du mal, elle apparait dans l'incertitude, en quete d'une identite, d'un nouveau role et d'une place dans un monde en voie de transformation. Cet article remet en question une définition de la fiction parue en 1988, dans un ouvrage intitulé « Contribution à une étude du concept de fiction ». Etant fondée sur la théorie des actes de langage, cette définition présentait en effet l’inconvénient de ne pouvoir s’appliquer qu’aux fictions verbales. Une nouvelle définition est donc proposée dans cet article, faisant apparaître clairement la fiction comme un concept de nature pragmaticosémiotique : une fiction est une représentation, verbale ou non verbale, qu’un auteur (...) produit consciemment dans le but de la transmettre à un destinataire. En transmettant cette représentation, l’auteur de la fiction adopte une attitude spécifique, consistant à inviter le destinataire à imaginer un monde fictif dont les caractéristiques sont compatibles avec celles du monde décrit dans la représentation. Sur la base de cette définition, l’article recense des exemplifications de fictions aussi diverses que possible, selon la nature de leur support de représentation et selon leur fonction, puis il pose la question du rôle des fictions dans notre vie quotidienne et, en particulier, sur la manière dont elles nous apprennent quelque chose sur le monde réel. This value can make it prudentially rational for you to stay alive even if it appears highly unlikely that you have a bright future ahead of you.
